General Terms & Conditions of Sale (short form)
Retailers Ordering
ORDERS:
Minimum order for carriage paid is £500 (ex VAT). £15 delivery charge will automatically be applied if this condition is not met.
Orders are processed in the order of receipt unless agreement is made at the time of placing the order. Any special request may result in a service charge.
Orders already processed cannot be amended.
GAWITH HOGGARTH TOBACCO TRADING Ltd. reserves the right to refuse any order without reason.
All orders must be within the agreed terms of account. All terms may be withdrawn if a purchaser persistently fails to meet the agreed terms.
No goods are sold on a sale or return basis unless prior agreement has been made in writing.
DELIVERY:
Delivery times are only an estimate and cannot be guaranteed.
Refusal of delivery unless for reasons concerning GAWITH HOGGARTH TOBACCO TRADING Ltd. will result in the purchaser being charged for the initial delivery and any further carriage charges.
GAWITH HOGGARTH TOBACCO TRADING Ltd. must be notified (without exception) of any: -
Damage or quality issue within 5 working days of delivery.
Faulty within 30 days from invoice date.
Shortages within 5 working days of delivery.
Packing errors within 5 working days of delivery.
Pricing errors within 5 working days of invoice date.
Non-delivery within 5 working days of invoice date.
PRICING:
All prices and price lists are subject to change at any time due to unforeseen cost increases and without prior notice unless a quote has been requested and agreed.
All prices quoted are exclusive of VAT.
Discounts, promotions and special pricing are at the discretion of GAWITH HOGGARTH TOBACCO TRADING Ltd. and can be withdrawn at any time and without notice.
RRP’s are for reference only.
RETENTION OF TITLE:
All goods whether delivered or not shall remain the property of GAWITH HOGGARTH TOBACCO TRADING Ltd. until all goods have been paid for in full by the purchaser or their representative.
All goods shall be sold as received and without change unless prior agreement has been agreed in writing with GAWITH HOGGARTH TOBACCO TRADING Ltd.
Payment will be made 30 days from invoice date unless prior agreement has been made in writing.
Unless trading on proforma terms, when full payment must be received before dispatch and within 48 hours of the order being placed.
All payments must include the customer number as a reference. Failure to provide a reference will result in unallocated funds on your account and delays to future orders.
Failure to pay to the agreed terms shall result in one or all the following: -
- Orders will be held until late payments are cleared (Approx. 48 hours).
- GAWITH HOGGARTH TOBACCO TRADING Ltd. taking possession of unpaid goods.
- Loss of credit facilities.
- Debt recovery via a 3rd party collection agency leading to the filing of a county court.
RETURNS:
All returns must be agreed in advance with the office. Returned items must be accompanied by a fully completed Return Form, copies of which are available from the office, your back office on the Gawith Hoggarth website and are also included with your delivery. The relevant Returns Number issued by the office must be clearly quoted.
All goods returned (except for Gawith Hoggarth error), will be at the expense of the purchaser unless previously agreed in writing.
GAWITH HOGGARTH TOBACCO TRADING Ltd. will not accept: -
- Products that have been delivered over 30 days prior.
- Products that are not in original packaging and fit for resale.
- Split outers of any product (tobacco, accessories or sundries).
- Tobacco that has been opened (unless damaged or faulty - notified as above).
- Damaged goods or quality issue without agreement from GAWITH HOGGARTH TOBACCO TRADING LTD delivered over 5 days prior.
- Faulty goods without agreement from GAWITH HOGGARTH TOBACCO TRADING LTD and, or older than 30 days from the product invoice.
- Dust is not accepted as a return for credit.
DEFINITIONS:
'Damaged’ refers to products that are cosmetically inferior and as such cannot be sold to consumers.
‘Quality issue’ refers to the actual tobacco e.g mould found
‘Faulty’ refers to products that are unable to function as intended due to defects.
‘Shortages’ refers to products ordered (as listed on the sales order) but not delivered.
‘Packing errors’ refers to incorrect products delivered compared to what is listed on the sales order.
‘RRP’ = Recommended Retail Price.
